Cemetery Speaker Series: Disinterments, Exhumations, and Grave Robbing

Mark S. Zaid is a Washington, D.C. based attorney who specializes in crisis management and innovatively handling simple and complex administrative and litigation matters primarily relating to national security, international law, foreign sovereign and diplomatic immunity, and the Freedom of Information/Privacy Acts. Since 2009, he has been named a Washington, D.C. Super Lawyer every year (including being profiled) and he is repeatedly named a “Best Lawyer” in Washingtonian Magazine’s bi-annual designation for his national security or whistleblower work. The Magazine also named him one of D.C.’s 250 (2021) and 500 Most Influential People (2022 & 2023), respectively, for national security/legal intelligentsia. And in 2022, Mr. Zaid was also awarded the status of “Lawyer Lifetime Achievement Member” by the Magazine for being featured on its Top Lawyers list at least 10 times out of the past 15 years. In 2020, the Washington Metropolitan Employment Lawyer’s Association named him “Attorney of the Year” for his work on the Intelligence Community Whistleblower’s case. Forbes Magazine announced him as one of the top 200 lawyers in the United States in their inaugural ranking list in 2024. As the National Law Journal once wrote, “if Agent Mulder ever needed a lawyer, Zaid would be his man.”

A 1992 graduate and Associate Editor of the Law Review of Albany Law School of Union University in New York, he completed his undergraduate education (cum laude) in 1989 at the University of Rochester, New York with honors in Political Science and high honors in History. Mr. Zaid is a member of the Bars of New York State, Connecticut, the District of Columbia, Maryland and numerous federal courts.

He is one of only a few lawyers who can claim to have litigated an exhumation case, having argued for the disinterment of the remains of presidential assassin John Wilkes Booth in 1995 in Kline v. Green Mount before the Circuit Court of Baltimore.

The words themselves seemingly resonate in our collective consciousness, conjuring images of the silhouettes of misbegotten characters, toting shovels, sneaking into a cemetery on a dark night, intent on their grisly work. While this cliche vignette might seem amusing, is it true? Or does it obscure an equally macabre but far more true reality? What happens when someone’s remains are raised from the grave? How was it done in the past? Does it still happen today? And if so, is it even legal?

To answer these questions and more, we hope that you will join us for a very special October edition of the Cemetery Speaker Series to learn, in a nutshell, the ins and outs of disinterments, exhumations, and grave robbing.

Mark S. Zaid, a Washington, D.C. based attorney and legal expert, will be providing an overview presentation of human exhumations and grave robbing, drawing from his own experiences throughout his career. After his remarks, one of our docents will lead attendees on a thematic walking tour of the cemetery grounds related to the cemetery’s history with all types of exhumations, including the theft of an Attorney General’s skull, moving a Vice President’s body, the mass exhumation of Chinese migrants, and more.

Keynote remarks will take place either outside or inside the Chapel, weather depending, and the walking tour will take place on the grounds. The tour is approximately 45 minutes in length. Please come prepared with comfortable clothing and shoes, as the tours often stray from the main paths.
